Amid this Corona crisis, the Canadian government has implemented some new regulations and policies related to immigration for new applicants of permanent residents (PR).
Traveling to Canada for immigration purposes during this outbreak can be a huge challenge for those who are planning to apply for Canada PR. They might be wondering how the federal government is addressing this critical situation.
The Immigration, Refugees, and Citizenship Canada (IRCC) have recently issued some guidelines for the new PR applicants whose plans have been drastically affected due to this pandemic. The IRCC has published some instructions keeping this Covid-19 outbreak in mind on May 29, 2020.
At present, the receipt of the new PR application will be continued.
Files that are not complete due to any reason particularly missing documents will be retained and reviewed by the concerned authorities within 90 days.
Completed new PR applications will continue to be processed as per the regular procedures.
However, if any new PR application lacks supporting documents, an explanation needs to be added with the application referencing ‘interruptions caused by the travel restrictions because of Coronavirus’. Providing this explanation is extremely important as it may result in the application promotion and review within 90 days. As per the latest notification, new applications will only be processed in the order in which they have been received.
If applicants fail to provide this explanation or PR applications that are not complete due to any unrelated reason to the Covid-19 may result in the rejection of the file or application.
Even though principal PR applicants who are already in Canada and have any dependent overseas can continue to have their applications processed as per the normal procedure, delays may occur in the processing. However, the main applicant must not be granted PR status if their dependents who are overseas are not able to travel due to any reason. Once they can travel, they will be informed of further steps.
PR applicants who are in the possession of the Permanent Resident Visa (PRV) or the Confirmation of Permanent Residence (CoPR) should inform the IRCC by using a web form if they are unable to travel before the expiry date of their documents.
The files will only be processed keeping the specific circumstances of the applicant in the mind.
Those who already have valid PRV and CoPR and unwilling or unable to travel should inform the IRCC sending a note explaining the situation that can further be added to their file. A reminder should also be added to the applicant’s file to mention the document’s expiry date. If things become normal or the PR applicant can travel right before the PRV’s and CoPR’s expiry date, then the authority will encourage them to use their present documents to land in Canada.
People whose PRVs and COPRs have already been expired are required to inform the IRCC regarding their unwillingness or inability to travel before the expiry date mentioned on the documents and request the authorities to reopen and review their files within 90 days.
Once the PR applicant has informed the IRCC through the web form that they are now able to travel, their application will be reopened to provide the applicant and their family members with re-approval whether they are accompanying or not, have passed the necessary medical exams for immigration, security, and criminal checks, and have valid passports.
In case the waiting period of 60 days is over and the applicant has not informed the IRCC regarding their travel, a note will be required to be added to the PR application for reconsideration after an additional waiting period of 60 days.
Since the Covid-19 outbreak started, the IRCC has reiterated that it will not refuse or close any application that is already in the progress due to any missing document. The authority has also introduced several special policies and improved flexibility during this pandemic to accommodate as many potential immigrants as possible.
